Functions: To record all proceedings of the court in a
timely and accurate manner. This includes sorting and filing documents received, coordinating and
setting hearings, reviewing orders and or judgments to ensure they are in compliance with the statues
as well as in proper form for the Judge’s consideration and act as liaison between attorneys and the
Judges.
The clerks are responsible for maintaining and processing all pending case files, processing all the
work generated in court daily in an accurate and timely fashion. Provide information requested to the
bar/public without practicing law. The clerks are responsible for receiving documents and updating
information into the JIMS system.

| Ancillary Court |
| The Ancillary Court is the “Court of First Resort” whose docket is determined by the Harris County Board of
Judges. The matters heard in this court are of equity, which have no adequate remedy at law. The judges who serve
on ancillary are the presiding judges of the Civil District Courts. Each judge serves one half of a calendar month
by rotation. All ancillary assignments are subject to change without notice.
At the present time, the only matters heard by the ancillary judge are temporary restraining orders and
tuberculosis (communicable disease) cases. These matters are heard as quickly as possible after they are filed with
the District Clerk’s Office. According to Rule 680 of the Texas Rules of Court (State):
“No temporary restraining order shall be granted without notice to the adverse party unless it clearly
appears from specific facts shown by affidavit or by the verified complaint that immediate and irreparable injury,
loss or damage will result to the applicant before notice can be served and a hearing had thereon.”
The Ancillary Court is located at 201 Caroline, Room 830. Hours of operation are 8:00 a.m. – 5:00 p.m.
(Monday – Friday). For any ancillary matter(s) after normal business hours, please call the Harris County Operator
at (713) 755-5000 for information. The judges are on call 24/7, including holidays.

| Filing Discovery Material |
Certain discovery material may be requested from either litigant while the lawsuit is pending. Discovery
provides an access to information that may be crucial to either side in the lawsuit. Certificates of written discovery
are no longer required by the Harris County Rules of the Civil Trial Division and should not be filed. Under Rule 191.4
of the Texas Rules of Civil Procedures, the filing of discovery material is limited as follows:
- Discovery material not to be filed:
- discovery requests, deposition notices, and subpoenas required to be served only on parties;
- responses and objections to discovery requests and deposition notices, regardless on whom the requests or notices were served;
- documents and tangible things produced in discovery; and
- statements prepared in compliance with Rule 193.9(b) or (d).
- Discovery materials to be filed:
- discovery requests, deposition notices, and subpoenas required to be served on nonparties;
- motions and responses to motions pertaining to discovery matters and deposition notices, regardless on whom the requests or notices were served;
- agreements concerning discovery matters, to the extent necessary to comply with Rule 11.
- Exceptions:
- the court may order discovery materials to be filed;
- a person may file discovery materials in support of or in opposition to a motion or for other use in a court proceedings; and
- a person may file discovery materials necessary for a proceeding in an appellant court.

| Seizure & Forfeiture |
| Under the Controlled Substance Act, property may be forfeited and/or seized when any property, other than a
controlled substance or raw material, is seized. Proceedings under this section shall be instituted within 30 days
after seizure and not thereafter. All Seizure and Forfeiture cases are handled in the
133rd Civil District Court. |
